Loss Mitigation Pro on Casey’s Mortgage Issues

May 30th 2007: In this post on IAFF, guest blogger LossMitPro gives Casey some pro-bono assistance.

LossMitPro writes a wordy introduction, explaining that he is helping Casey "free, gratis, zilch, nada, zip, zero-money paid by Casey," under the proviso that he is "allowed to (at my sole discretion as to specifics) post periodic updates about my progress." He describes his purpose:

Although my function is primarily to negotiate final settlements with all applicable mortgage lenders, some unsecured creditors will be involved as well. These include mortgage notes that have been converted to unsecured, through foreclosure processes – second trust deeds. While I intend to position Casey’s unsecured debt (Credit Card, personal loans, etc.) for final resolution, such will come much later after all subject mortgages have been dealt with.

Updates are planned every Wednesday, on topics "ranging from general mortgage default issues, to the Serin story itself."

LossMitPro closes with a copyright statement which states "Permission is required before fair use application." Nice try, pal, but no: permission is not required for fair use, including review, comment, criticism, and parody.

LossMitPro inevitably draws a lot of fire for his creative approach to fair use; Soem Dood sums up:

How does it feel to instantly blow ALL of your credibility with that Fair Use horse manure, right off the bat? Man, the first pitch didn’t even come across the plate yet, and here you are already heading for the showers.

Stung by accusations that he's only in it for the exposure, and burned by IAFF's never-say-never death and ill-advised resurrection, LossMitPro's association with Casey reaches its inevitable bitter conclusion:

In a very short time each and every post under the nom de plume (pseudonym) of LossMitPro, will vanish from IAFF… Poof! And if they don’t then Casey will see a side of me that’s not so pretty, and this site itself may go poof once again! (Yeah, it’s like that; give me the power of Subpoena and watch what happens to our golden boy? Methinks Casey knows better, but I’ve been wrong about him thus far – he may just decide to play me further for a fool.)

The post is deleted by Casey on June 8th 2007, in an apparent acquiescence to LossMitPro's demand. All comments on other posts by, or relating to, LossMitPro are also deleted.

From later statements on EN by those knowledgeable regarding the required demeanor for the industry, apparently this bullying behavior is de rigeur for 20 year executive-level loss mitigation professionals. Wheedling a blog owner to have potentially embarrassing posts removed after they had been voluntarily made is just a normal part of a typically busy day that might include various empty legal threats (later to be redacted), bluster, wordy diatribes, suing non-profits about dog pooh, and back pedaling over the nature of secret business agreements with serial mortgage fraudsters (i.e. pro bono versus for profit).
