Mark Villasenor is Suing Me and My Innocent Family - Please Help!

June 29th 2007: In this post on IAFF, Casey pleads for assistance with an impending lawsuit.

Ambushed by LossMitPro on his Friday talkcast with a threat of impending Superior Court legal action, Casey plays the "poor poor me" card:

I think he claims that I’m breaking some law about “profiting from crime” or something like that. What crime??

Mortgage fraud.

All I have done is share my mistakes in real estate investing and loans on this blog - openly and honestly - in order to help others. Yes, I have done some shady things but I’m not boasting about it, but on the contrary telling people NOT to cut corners!

Still mortgage fraud.

Casey reproduces the email and the text of the complaint, but carefully redacts the names of Marty Stewart and PageDaddy.com. Too late, Casey: CNET News's reporting already put those names squarely into public domain. He does not, however, reproduce the text of his contract with Marty, which clearly LossMitPro is also in possession of and which allegedly supports "perpetrations of fraud and manipulation of Google search engine systems."

Casey pleads with his community "to step in and help me deal with this Mark Villasenor guy." Will his supporterz, including Mocha, named in the suit, rally around him? Or will they flee like roaches when the light goes on?

Casey later comments to try to explain some of his history with Mark; an explanation which rapidly turns into a whiny rant:

I realized that he was using bully tactics to try to show some variation of “tough love” and he wants to see me succeed, in HIS way.I’m sick of these people (Mark and Duane and others) trying to play parent or big brother and telling me how to live my life. Hey I always consider advice but when they try to FORCE me to do things THEIR WAY, that’s just AIN’T RIGHT!^[1]

Svetogorsk has little patience with this:

Grow up, Casey. You’re whining like a petulant teenager who’s been grounded for a week, not someone facing legal action and the very real prospect of jail time.

You want to play bigshot businessman without the knowledge, experience or smarts to pull off these “sweet deals”, you deal with the consequences. You screw your colleagues over, you deal with the consequences. You ignore the requirements laid out in legally binding contracts WHICH YOU VOLUNTARILY SIGNED, you deal with the consequences. You ignore chance after chance to put things right, and you deal with the consequences.^[2]

Casey goes on to complain further: "Mark Villasenor has blatantly stolen / violated our copyrighted voice recordings from my publishers’ site. He said he is doing that to provoke my publisher to sue him."^[3] Svetogorsk again refutes him: "because it’s Mark’s contention that the recordings amount to cast-iron evidence of criminal intent and action on your part. If you think he’s wrong, you’re free to sue him, but you know full well that this will mean airing the contents of the recordings in open court."^[4]

And digging a deeper and deeper hold for himself, Casey attempts to reveal Mark's "hot head" behavior:

Back when we first talked about him helping me out he was VERY concerned about what the “haterz” might do to him. So what does he do? He goes on the hater blogs and pretends to be a hater himself, with an occasional positive remark, to make him look hater-neutral. Later he had me act out a scene on one of the previous podcasts where I beg him for forgiveness and ask him to work with me. And his line in the play was “Ooh OK, Casey I will still work with you.” [...]

The thing about the “play” was pretty funny because I thought “why is he so concerned about the haterz”. Either deal with the possability of them writing crap about you by associating with me or if you can’t handle it, don’t work with me. Simple as that. But he tried to play both sides. I am only saying this because it shows you what I’m having to deal with and it relates to Mark’s tactics.^[5]

Casey also attempts to clarify the role of his mother Anna, also named in the complaint: "This person just happened to guarantee my corporate lines of credit which I was raising to get back into doing business. The person is no longer involved with that. Which is all good." and reveals that he has been planning to use the corporation to shelter assets: "I was considering putting the blog into the corporation somehow so I can show income and get tax advantages / asset protection, etc but haven’t had a chance to get some legal advice on this."^[6]
