My Mortgage Docs To Be Reviewed by Truth-In-Lending Expert
From CaseyPedia
July 22nd 2007: in this post on IAFF, Casey continues to attempt to recast himself as a victim.
Casey has submitted his mortgage documents to an expert who is part of an as-yet-unnamed group that helps borrowers fight predatory lenders: "there is an option to sue the lender and sometimes even get your mortgage forgiven."
The post is accompanied by an artful photograph of a sheaf of Casey's documents, which highlights Casey's 10.95% APR but which carefully obscures the answer to the question "Do you intend to occupy the property as your primary residence?".
[edit] Comments
The comments are overwhelmingly "you've got to be kidding" disbelief, probably best summarized by Rob Dawg with the succinct line:
- Predatory lending?!? Kewl, maybe you can get back all the money they took from you.[1]
Casey later comments to further bang the "I didn't know" drum:
- If only ONE person would have told me that anything I’m doing is ILLEGAL or I can go to JAIL for any of my deals or loans, I would have not gone further. The best I got was “gray area” while most of my professionals / investors / associates / gurus didn’t think there was anything wrong.[2]
WhatAMess immediately replies:
- You needed to be *told* that lying on loan documents was fraud?
Do you need to be told to breathe in again after you breathe out?[3]
bobcrane adds:
- Correct me if I’m wrong, Skippy, but I’m seeing an entire blog full of comments telling you just that.[4]
Stung by "some serious amount of hatin’ happenin’ here", Casey mangles "a line straight out of the bible… Those without sin let them throw the first rock.":
- In other words, tell me which one of you have NEVER overstated ANYTHING (including little things) on ANY application or resume or tax return or whatever. Not saying this as an excuse, I’m just trying to put all this in perspective.[5]
Ah, perspective. So important when you're staring down multiple counts of mortgage fraud. Casey rapidly posts another comment to further defend his "it's not my fault" position:
- "I was shown how to get cash-back at close."
- "I do that exact thing and tell my mortgage broker what I’m trying to do and tell my realtor (on the few properties where I used a realtor) what I’m trying to do."
- "They show me what I need to do to get it done and find me the right type of financing. In all the cases the loan applications [were] filled out for me since they knew better what to state, to make it fly, etc…"[6]
The backpedalling continues: now we're told that "I haven’t been telling the full story." Well, big news there, Snowflake. But it's all our fault he's labeled "a scammer a fraudster a criminal" now, because we just don't understand:
- I’ve always been under the [belief] that its better to take responsibility, even if its not completely my fault. However, under the circumstances I’m in now and the crazy “movement” (haterz that don’t understand how the industry works) around my story, I regret NOT telling the story the CORRECTLY way from the start.[7]
[edit] Reactions
Rob Dawg comments further at EN: "You don't ask for a basement inspection when you've buried bodies down there."[8]
LossMitPro breaks legal silence to comment on CH.C and EN:
- These mortgage challenge schemes are illegal and have been around for sometime. They offer no credible service other than pretending a secured debt can be eliminated, simply by threat of suit based on too often erroneous grounds. [...]
- These firms first pretend an analysis of loan docs, and then charge thousands to “represent” borrows in purported action. Naturally, suit is never engaged but the consumer’s money is long gone. Simply, what Casey is falling for is a scam and I’ve advised him of as much sometime ago.
- Moreover I PERSONALLY know Countrywide (one of Casey’s lenders) isn’t going to find this tact amusing.[9]
Rob responds to Casey's defensive comments with a new post at EN:
- Okay, now I'm pissed. It takes a lot for Casey to piss me off but this does it. I know EXACTLY how the industry works. Fliptard STILL doesn't have a frakin' clue and he presumes to lecture?[10]
LossMitPro also responds to the "how the industry works" comment:
- Hmmm, well, THIS HATER understands the “industry” extremely well (if he says so himself). And has heard many stark admissions direct from the source, detailing how the 45-day CBR tape-to-tape lag was deliberately manipulated to acquire mortgage funding. As for regrets; clearly the only thing regrettable in the eyes of our subject, was being so verbose about the acts.[11]
